Legal framework
The procedures for tax-deductible asset disposal are set out in Italian Presidential Decree No. 441 of 10 November 1997, Italian Ministry Circular No. 193/E of 1998, and the simplifications introduced by the "Development Decree" (Italian Decree-Law 70/2011, later converted into Italian Law No. 106/2011). Companies or VAT holders seeking to dispose of unusable goods must adhere to the above-listed provisions. Exceptions apply to disposals valued at less than €10,000, for which self-certification is sufficient. NB: The €10,000 threshold is based on the purchase cost, not the current market value of the assets.
